We offer this e-commerce platform, including all information, tools, and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.  By visiting our site and/or purchasing gym items from us, you engage in our "Service" and agree to be bound by the following terms and conditions. These Terms apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/or contributors of content.

2. Legal Capacity and ECTA Compliance

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your province of residence. In accordance with the Electronic Communications and Transactions Act 25 of 2002 (ECTA), our specific business credentials are provided below for transparency:

3. Products, Pricing, and Currency

  • ZAR Currency:  All prices displayed on our website are quoted in South African Rand (ZAR).
  • Price Adjustment: We reserve the right to alter pricing structure or discontinue any piece of gym items at any time without prior notification.
  • Weight & Dimensions: We endeavor to reflect specifications as accurately as possible, but we do not warrant that product images match physical variants flawlessly.
4. Third-Party Payment Gateways

Because our store is hosted on Shopify, payments are processed via integrated South African secure third-party payment gateways (e.g., PayFast, Peach Payments, Yoco, Paystack, or Ozow). By choosing to finalize your order, you agree to operate within those specific merchant payment rules. We do not store your complete banking credentials or credit card digits on our native databases.

5. Shipping, Courier Delivery, and Heavy Goods Delivery
  • Courier Terms: Delivery is executed via specialized third-party road freight couriers to the delivery address provided during your checkout sequence.
  • Delivery Area Limits: We deliver nationwide within South Africa. Surcharges may apply to remote outlines, farms, or plots.
  • Risk of Loss: The risk of damage or loss passes onto the consumer immediately upon signing the courier delivery note.
6. Statutory Return Policy (CPA & ECTA Compliance)
Our return protocols completely abide by South African legislative baselines:
  • ECTA 7-Day Cooling-Off Period: In terms of Section 44 of the ECTA, you are entitled to cancel any online purchase of stock items within 7 days of receipt without penalty or justification. The item must remain completely unused, unbuilt, and sealed in its original boxes. You will be liable for the direct cost of courier shipping back to our warehouse.
  • CPA 6-Month Implied Quality Warranty: In terms of Section 56 of the Consumer Protection Act (CPA), if items arrives broken, develops an inherent manufacturing fault, or proves unsafe within 6 months of delivery, you are legally entitled to request a repair, replacement, or full refund. We will cover the retrieval transport costs for legitimate CPA defect claims.
  • Exclusions: Gym items explicitly custom-fabricated, modified, or specially tailored to individual specifications cannot be returned under the 7-day cooling-off rule.
7. Limitation of Liability and Indemnity
To the maximum degree permitted under South African common law and the CPA:
  • The Company, its directors, employees, or sub-contractors will not be held liable for any direct, indirect, incidental, punitive, or consequential damages, or personal bodily injuries resulting from the misuse, improper assembly, or altering of our items.
  • You agree to indemnify, defend, and hold harmless our company from any third-party claims arising out of your breach of these operational terms.
9. Privacy and POPIA Compliance

Your personal details, address information, and contact logs are processed strictly in accordance with our Privacy Policy and the Protection of Personal Information Act 4 of 2013 (POPIA). Please review our dedicated POPIA policy page for granular tracking disclosures.

10. Governing Law

These terms and conditions, alongside any singular transactional purchase agreements whereby we provide gym products to you, shall be governed by, executed, and interpreted purely according to the laws of the Republic of South Africa. Any legal challenges fall under the non-exclusive jurisdiction of South African courts.
